  1. The premise is let to you for holiday purposes during the period stated on your booking confirmation email.

  2. The premises will be available from 2:00 PM on the day of arrival and checkout time to be no later than 10:00 am on the day of departure. Sheoak & Sand Stays will be in contact via email to discuss the options of an earlier check in and later check out. The premises are to be always kept clean and left in a clean and tidy condition. Failure to do so will incur an additional cleaning charge, which will be deducted from the security deposit. Please note we cannot offer early check-ins or late check-outs during peak periods.

  3. Sheoak & Sand Stays accepts no responsibility should the property be unsatisfactory to the guests on arrival. The description of the premises by us, is given in good faith and as accurately as possible, therefore no responsibility for misrepresentation will be accepted.

  4. Please be always considerate of neighbours. Functions and parties are not permitted and are not covered by insurance.

Payment & Cancellation policy

  1. For all bookings, the balance of the tariff is to be paid no less than 30 days prior to the arrival date. For bookings made within 30 days of arrival date, full payment must be made at the time of making the booking.

  2. Bookings will only be confirmed once a 50% deposit and the Security Deposit have both been paid. Confirmation is subject to the completion and return of the signed Terms & Conditions

  3. Tariffs are subject to change without notice, until deposit payment has been received.

  4. All properties require a $1500 security bond which is taken upon booking confirmation.

  5. Please note that the Security Deposit will be processed back into your account 14 days after departure. Any claims against your Security Deposit may include but is not limited to the following: excess cleaning fees, excess garbage removal, damage or breakages at the property, late check out, security guard/police call out.

  6. Tariffs are subject to change without notice until deposit payment has been received. A deposit of 50% is required to confirm booking and the 50% balance is payable 30 days prior to arrival. We charge a $85 non-refundable booking fee and a $1500 Security Deposit upon booking confirmation.

  7. All damages, breakages or losses to the property or furnishings will be paid for by the guest and must be reported to our us immediately. Loss of keys attracts a $50 charge for each set, with a $25 call out fee for misplaced keys. Please note, that you may be liable for a locksmith charge, should a replacement of locks be required.

  8. Sheoak & Sand Stays and/or the Owner are not responsible for the guest’s personal property.

  9. If the property is offered for sale, the guest agrees to allow the owner or an agent to inspect the property with prospective purchasers, by appointment, during reasonable hours with 24 hours’ notice.

  10. Garbage Collection:  Your rubbish bins are to be put out on Monday night for a Tuesday collection and in peak season Friday night for a Saturday collection.

  11. Garbage must fit inside the bins. The red garbage bin is for general garbage and the yellow garbage bin is for recyclable items only. If the yellow bin is contaminated with regular garbage there will be a $50.00 fee as the recycle collectors will not take it. If provided, the green is for green waste only. Any excess garbage over and above what will fit inside the rubbish bin must be removed from the property prior to check out. If not, a rubbish removal fee will apply. The garbage truck will not pick up any garbage left outside the bin.

  12. No pets of any kind are permitted at any property, unless the property is specifically advertised as pet friendly. Failure to heed to this, will result in eviction.

  13. Although we will be as flexible as possible, refunds are generally not permitted for circumstances including; 

    • A change of travel plans 

    • Disruptions to transportation to the property 

    • Illness 

    • A lack of access to attractions (such as wineries or events been cancelled) due to factors beyond our control (such as bushfires, inclement weather, etc) 

    • Forecast weather or other environmental impacts (such as rain, smoke haze, extreme heat or cold, high winds, bushfires, floods, etc)

General Terms and Conditions

  1. Sheoak & Sand Stays cannot accept responsibility for actions taken by the owner of the premises outside our control and we reserve the right to cancel any booking as per the owner’s instruction. If the property becomes unavailable for your stay due to unforeseen circumstances e.g., fires, storm damage, sale, sustained road closures, etc we will inform you and endeavour to arrange suitable alternative accommodation for your stay.

  2. It is the guest’s responsibility to check that the booking dates are correct and advise the agent immediately if there are any irregularities. Sheoak & Sand Stays will not be held responsible for any missed discrepancies.

  3. The guest making the booking must be present at the property for the duration of the booking and will be held responsible for the conduct of all other guests and visitors.

  4. At the time of booking the guest must nominate the maximum number of people that will occupy the property and this number must not be exceeded under any circumstances. Bookings will not be accepted where the number of guests exceeds the maximum number of occupants as advertised in the property description.

  5. If the guests are found to have exceeded the accepted number of occupants upon the property, the tenancy will be immediately terminated, and the guests must vacate the property immediately. Under these circumstances no refund will be given, and alternative accommodation will not be made available. No outside visitors are permitted at the property without written approval from Sheoak & Sand Stays.

  6. In the case of apartments, units ad villas car parking or carports are usually umbered. Extra vehicles, boats, etc are to park outside of the grounds, or othersatisfactory arrangements made with management.

  7. No mattress, tents or caravans, or more cars than the property accommodates are allowed. Automatic loss of the Security Deposit will apply.

  8. No guests under the age of 21 will be permitted to occupy holiday properties unless accompanied by an adult. We reserve the right to reject bookings from school leavers and or university leaves from mid/late October to early December as we do not have the policies, procedures, or resources to meet unique needs of those attending the annual “schoolies” event. If on check in persons that are part of the booking are fount to be participating in “schoolies” they will not be checked in and no refunds will be given. Any schoolies bookings carried out by parents or others o circumvent our terms and conditions will result in immediate eviction from the property by security contractors and local police (if required).

  9. Each property may have additional rules or conditions that apply to their property. These conditions are noted on the website listing, emailed to guests and are displayed within the property and will form part of these Terms and Conditions. Any breach of these conditions may result in immediate termination of your tenancy.

  10. The property may have a wireless internet connection (wired or wireless). The operation of any internet connection during your stay is not guaranteed and may be disrupted or unavailable. The guest will not hold Sheoak & Sand Stays or the owner liable for the availability or disruption in any internet connection or phone service providers. We will do our best to rectify the issue. TV, Foxtel, internet, and some phone providers in parts of Pacific Palms, Smiths Lake and Seal Rocks can be unreliable in times.

  11. Use of gymnasium or water equipment in the property (if any) by the guest or any occupant occurs solely at the risk of the person using that equipment. Children must be prevented from using any gym/water equipment. In the event of minor faults and/or malfunctions of appliances or inclusions, there is no obligation from Sheaok & Sand Stays or the owner to compensate discount.

  12. Items left at the premises will not be automatically returned. Any found items will be held for a maximum of 2 weeks and then disposed of or passed on to charity. Items may be returned only upon receipt of payment for postage and packaging costs, but lost items are not the responsibility of Sheoak & Sand Stays.

  13. All plates, glasses, cutlery, utensils, etc. used by the guest must be washed, dried, and packed away before vacating. The property should be left in the same condition upon departure as it was found on arrival. Any additional costs where an unreasonable amount of cleaning is required must be paid for by the guest.

  14. Barbeques must be left in a clean and tidy state ready to be used by the next guest. Guests may be charged a $50 fee if the barbeque is not cleaned before departure. If the barbeque is dirty on arrival guests should contact the agent immediately. If the gas bottle runs out, guests may take the bottle to Charlotte Bay Service Station/Foodworks on the Lakes Way for a “Swap & Go” replacement gas bottle, guests to retain receipt for reimbursement

  15. All property interiors are non-smoking. Guests failing to abide by this term may be responsible for the cost of cleaning all carpet, furnishings and window coverings, and any other associated costs for damage to the property.

  16. Guests must comply with any instructions from Sheoak & Sand Stays during their stay including allowing repair or service personnel to enter the property for the purpose of conducting any repair or service deemed necessary by the agent.

  17. All repairs will be affected as soon as practicable. On Public Holidays, weekends and after hours this may at times prove difficult. Sheoak & Sand Stays will attempt to minimise inconvenience caused but cannot issue partial refunds or give discounts. In the event of a major problem rendering the property uninhabitable, we will make every effort to find alternative suitable accommodation for guests.

  18. Neither the owner nor Sheok & Sand Stays is responsible nor has any control over building or renovation work being carried out on neighbouring properties, public areas and tourist attractions and cannot issue refunds in the event of such circumstances.

  19. No firecrackers are to be used at any time whilst staying at the property. Complaints received from neighbours may result in a fine taken from your Security Deposit or immediate termination of your tenancy and eviction from the property. No open fire pits are permitted at any time throughout the year and will result in an immediate termination of your tenancy. If a fire pit is present at the property, it may not be used when there is a fire ban. No fires are permitted at properties that do not supply a fire pit, e.g. you cannot bring your own fire pit.

  20. If there is a pool or other large body of water on or nearby the property, the guest must provide adequate supervision of any children at the property at all times and gates to fenced off areas must remain closed when not in use. Sheoak & Sand Stays cannot be held responsible for any incidents arising from a lack of supervision.

 

Code of Conduct & Neighbour consideration

  1. All guests are required to comply with the NSW Code of Conduct for the Short-Term Rental Accommodation Industry.

  2. All local council and any all-relevant body corporate regulations must be strictly observed regarding any behaviour which may result in nuisance or disturbance to adjoining neighbours.

  3. To ensure the quiet enjoyment of neighbours, all noise should be kept within acceptable levels. Noise is defined as any sounds that can be heard from neighbouring properties that disturbs their peace & quiet, including arrivals & departures particularly at night.

  4. This means no one in the neighbourhood should be woken or disturbed by your noise.

 

Pet Friendly Property Guidelines

  1. You agree to be responsible for any dogs at the holiday premises during your stay and that only well behaved and supervised dogs are allowed inside the holiday premises. Dogs are not to be locked inside when you are away from the property. 

  2. Sheoak & Sand Stays accepts no responsibility for the security of pets within the property parameter regarding the integrity or suitability of fencing.

  3. Pets are not allowed on any of the furniture or beds.

  4. You agree that any breakages / damages, extra cleaning, or dog odour left at the holiday premises during your stay must be paid for and can be deducted from your security deposit on behalf of the owner.

  5. You agree to hose down areas of grass where dogs have urinated and collect and dispose of any dog waste left by dogs at the holiday premises.

  6. You agree to treat your dog/s for fleas and ticks prior to your stay at the holiday premises and ensure that your dog’s vaccinations are current.

  7. You will not allow dogs on the holiday premises that are vicious and/or that are excessive barkers and/or that are 'dangerous dogs' as denied in section 5 of the Companion Animals Act 1998.

  8. You will not allow your pet in the pool or spa as pets disrupt the chemical balance and will require an extensive pool service with shock treatment. This will incur a fee of $200.

  9. You are agreeing and accepting these terms and conditions when you make confirmation and payment for this booking.

 

You are agreeing to these terms and conditions when you confirm and make payment for this booking. Any breach of the above holiday letting terms and conditions, as agreed by both parties, permits the owner and/or Sheoak & Sand Stays to refuse the keys, retain rental payment in full, or immediately terminate the letting.
